These are the terms and conditions which apply to the Australian Walking Holidays “Subscribe and Win a Gear Gift Voucher” promotion. Please read all terms carefully. By subscribing to the Australian Walking Holidays e-newsletter during the promotion period you will receive an entry into the draw.

Who can enter?
Entry is open to all Australian residents aged 18 years or over, during the entire Promotional Period (1 August – 31 October 2019) who subscribe to the Australian Walking Holidays e-newsletter at www.AustralianWalkingHolidays.com.au
Each new unique email address subscribed receives (1) entry into the draw.
Employees and their immediate families of the promoter and agents associated with this promotion are ineligible to enter.

Prize Terms
Any ancillary costs associated with redeeming the Wild Earth Gift Voucher are not included. Any unused balance of the Wild Earth Gift Voucher will not be awarded as cash. How to enter
Promotion commences 12:01am AEDST on 1 August and closes 11:59pm AEDST on 31 October 2019 (Promotional Period).
Entry is free.

Each new unique email address will obtain (1) entry into the draw.
Promoter’s rights with respect to entries and entrants
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
a) to disqualify any entrant; or
b) subject to any written directions from a regulatory authority, to take such steps as the Promoter considers reasonably necessary to address the interference or change of circumstances which may include modification, suspension, termination or cancellation of the Promotion.
Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The draw
Entry into the Draw opens at 12:01am AEDST on 1 August and closes 11:59pm AEDST on 31 October 2019.
The Draw will take place at World Expeditions Travel Group, Level 5, 71 York Street Sydney at 3:00pm on 5 November 2019 AEDST
Computer Generated Selection will draw out the one winner from eligible entries.
The prize winner will be notified by email and the winner’s name will be published on the Australian Walking Holidays website and corresponding Facebook page.
The Promoter’s decision in relation to any aspect of this Promotion including with respect to any aspect of the draw and the prize-winner is final and binding and no correspondence will be entered into. By accepting the prize, the prize winner agrees to cooperate with the Promoter in regard to further promotion, marketing and publicity purposes.
Unavailable and unclaimed prize
If the prize is unavailable due to any reason beyond the reasonable control of the Promoter, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
If the prize is unclaimed within 1 month of the draw date, a draw for the unclaimed prize may take place on 1 month from the draw date at the same time of day and place as the original draw, subject to any directions from a regulatory authority. The Winner will be contacted by email. If the prize for the unclaimed prize draw is unclaimed by 20 December 2019, the prize will be forfeited.
If for any reason this Promotion does not run as planned by the Promoter or is likely not to run as planned by the Promoter, changing, modifying or suspending the promotion is subject to relevant state and territory regulations. A promoter/agent cannot change, modify or suspend a promotion without permission from the state bodies who issued permits for this promotion.
Privacy and consent of the entrant
Entrants consent to the Promoter using the entrant's name, in the event they are a winner in any media without remuneration for the purpose of promoting this competition (including any outcome).
No liability of the promoter
The entrant is solely liable for the costs he or she incurs in entering the Promotion and claiming the prize.
Neither the Promoter nor its officers, employees or agents are liable for:
a) A personal injury or distress caused by a prize
b) Any loss, damage or expense (including loss of opportunity) suffered directly or indirectly as a result of entering or winning the Promotion Except for injury, loss, damage or expense caused by the fraud, gross negligence or breach of contract by the Promoter.
The types of liabilities contemplated by paragraphs (a) and (b) include, but are not limited to technical difficulties, equipment malfunction, theft, unauthorised access, an entry or prize claim which is late, lost, altered, damaged or misdirected due to an act or omission beyond the reasonable control of the Promoter or tax liability.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable or illegible booking entries will be deemed invalid.
Except for any liability that cannot be excluded by law the Promoter shall not be liable for any cost, expense, loss or damage whatsoever which is suffered (including but not limited to indirect or inconsequential loss) or for any personal injury or damage to property which is suffered or sustained as a result of accepting the prize.
